No Fault Insurance
As discussed in the sections of Auto and Motorcycle coverage, No Fault Insurance is intended to guarantee payment of specific economic losses, without regard to fault, that result from a motor vehicle accident. On the flip side, the no fault laws impose specific limitations on a person’s right to recover damages for noneconomic losses which are suffered by the party which was not at fault for the accident. The rules are specific, but even so there has been much litigation on what would otherwise appear to be fairly basic concepts. For the most part, the Michigan courts have been very pro-insurance company when it comes to deciding issues relating to an injured person’s entitlement to benefits.
