Insurance Coverage Litigation Issues
Motorcycle Insurance
In Michigan, motorcycles are not statutorily defined as motor vehicles and are not, therefore, required to carry personal injury protection [PIP] benefits. These benefits include wage loss, medical expenses and replacement service expenses. So, if a motorcyclist is involved in an accident that does not include a motor vehicle, the operator may not be entitled to any such benefits. However, if the motorcyclist is involved in an accident with a motor vehicle, whether a car or a truck, then he would obtain his PIP benefits from the insurer of that motor vehicle.
While not able to have PIP benefits, motorcycles are required to carry PLPD, or Personal Liability & Property Damage coverages. These are, in essence, liability coverages designed to provide protection from injuries and damages caused by the negligence of the motorcycle operator. And, the failure to carry these statutorily required coverages may result in criminal penalties and total disqualification from a right to receive PIP benefits should the motorcycle be involved in an accident with a motor vehicle.
Also, uninsured motorist benefits are available on motorcycle policies, but underinsured coverage not offered by every insurer. In this day and age, it is a very important coverage. We can assist you in reading and understanding your policy, and consult with you to determine what coverages you have, what you may need, and from which company those coverages may be available.
The sad reality is that injuries resulting from motorcycle accidents are generally severe and catastrophic. When you are involved in such an accident, you need someone who is well versed to address the many issues which arise, issues which are frequently outside the reality of traditional motor vehicle accidents.
